Service of Process Fee

(a) The Lamar County Commission may levy an additional fee for the personal service of process by the sheriff or his or her deputies or agents of documents filed in the civil division of the district and circuit court in the county as follows: (1) For the personal service of process of civil papers in the courts of Lamar County or from any other county in the state, the fee shall be fifty dollars ($50). (2) For the personal service of process by the sheriff of civil papers sent to the sheriff for service from a court outside of the state, the fee shall be seventy-five dollars ($75). (b) The fees shall be collected by the appropriate court clerk and shall be forwarded to the Lamar County General Fund. Fifty percent of the proceeds shall be distributed to the office of the sheriff to be used to defray the costs of personal service and for the operation of the office of sheriff.
