Alabama Code § 44-1-35

Petition for Examination or Review by Director or Court

In the event any committed youth has not been examined as provided in Section 44-1-30 or has not been reviewed within nine months of a previous review as provided in Section 44-1-34, such youth or his or her parent or guardian shall be entitled to petition the State Youth Services Director for such examination or review and to have his or her petition given prompt consideration in accordance with appropriate rules established therefor. In the event such petition to the director has not been granted or where it has not been acted upon within 30 days, such youth or his or her parent or guardian shall be entitled to petition the committing court for such examination and review, and the same shall be granted. Pending the determination of such a petition by the court, the authority of the Department of Youth Services to take such action as it may deem necessary with respect to such youth shall in no way be affected.
