(a) The secretary may adopt reasonable rules concerning the operation of vessels and concerning the enforcement of this chapter. All fines collected shall be deposited into the State Treasury to the credit of the State Water Safety Fund. (b) In addition to all other penalties, the secretary, by rule, shall assign each type of boating violation a point value through the creation of a point system by which boater safety certifications may be suspended or revoked, as well as hearing procedures related to the suspension or revocation of certifications. Point values shall be assigned based on the severity of a boating violation, as determined by the secretary. Reports of boating violations shall retain their point value for suspension purposes for a period of two years from the date of conviction; provided, if any period of suspension is mitigated, the points shall remain effective during any period of probation which may be imposed. (c) Unless otherwise provided by law, the penalty for the violation of any rule adopted under this article shall be a boating violation.
