Suspension of Eligibility for Inmates of Certain Public Institutions; Temporary Reinstatement

(a) An inmate of a public institution under the administrative control or responsibility of the Department of Corrections shall have his or her eligibility for Medicaid suspended, but not terminated, provided he or she is otherwise eligible for Medicaid benefits. (b) An inmate of a public institution under the administrative control or responsibility of the Department of Corrections who is otherwise eligible for Medicaid benefits shall be eligible for temporary reinstatement of Medicaid eligibility for care received outside of such a public institution as an inpatient in a medical institution for more than 24 hours. (c) A public institution under the administrative control or responsibility of the Department of Corrections may make efforts to establish eligibility for or renew Medicaid eligibility for an inmate prior to his or her release from the public institution.
