Payment of Expenses Incurred in Transporting an Accused Individual

(a) Expenses incurred in transporting an accused individual shall be paid as follows: (1) When the individual is accused of a crime punishable by confinement with the Department of Corrections or death, the expenses shall be paid out of the State Treasury, on the certificate of the Governor and warrant of the Comptroller. (2) In all other cases, the expenses shall be paid out of the county treasury in the county in which the crime is alleged to have been committed. (b) Notwithstanding any other provision of law regulating expenses of state officers and employees, the sheriff or other agent of the state shall receive all of the following: (1) One hundred dollars ($100) per day while going to and returning from the place where the prisoner is arrested or confined. (2) Actual necessary expenses. (3) Transportation expenses, which shall be reimbursed as provided under Article 2 of Chapter 7 of Title 36. (c) Any expenses incurred by an agent of another state may also be paid pursuant to subsection (a).
