Arrest, Detention, and Prosecution

(a) Any violation of this article may only be prosecuted in the circuit or district court. (b) In any criminal proceeding brought pursuant to this article, the crime shall be considered to be committed in any county in which any part of the crime took place, regardless of whether the defendant was ever actually present in that county, or in the county of residence of the person who is the subject of the theft by retail theft or organized retail theft. (c) Any arrest or detention by a retail merchant shall be subject to the requirements and protections as provided in Section 15-10-14.
