Limitation on a Municipality’s General Operating Budget That May Be Derived from Traffic Ticket Fines and Penalties

(a) Only 10 percent of a municipality’s general operating budget may come from fines and penalties retained by a municipality from traffic tickets. Any remaining amount in excess of the 10 percent threshold shall be transferred to the Department of Finance for allocation, in equal amounts, to the Crime Victims’ Compensation Fund, created pursuant to Section 15-23-16, and the Fair Trial Tax Fund, created pursuant to Section 12-19-251. (b) In determining the total general operating budget, a municipality shall use the most recently completed year’s budget. (c) Class 1 municipalities are excluded from this section.
