STEPHENSON, Justice, dissenting. I cannot agree that this case should be reversed for a new trial for the reason that a second-degree manslaughter instruction was not given. The plan for shooting out tires and evidence that there was no scheme in advance to kill the victim are irrelevant to the instruction.
