PARKER, Circuit Judge: On February 4, 2000, the government filed a motion to dismiss Defendant-Appellant Jose Gomez-Perez’s appeal in this case, arguing that Gomez-Perez had waived all rights to appeal so long as his sentence was within the range stipulated to in the plea agreement.
