Arterburn, J. The Appellants, Thomas Pulliam, Robert G. Reed, and Gilbert D. Price, were convicted on September 23, 1974, of commission of a felony while armed and assault and battery. On October 15, 1974, the trial court on its own motion vacated the assault and battery convictions of the Appellants.
