The respondent is charged with the crime of rape, committed upon his daughter, Eose Evans, on September 20, 1885, at Harrisville, Alcona county; and upon his trial in the circuit court for said county, April 5, 1888, was found guilty of .the offense charged. Upon his arraignment in the circuit court, under the information then filed, he interposed a plea in abatement, which was overruled by the court.…
