FLAUM, Chief Judge. Mark Bell owns a vacation home on the shoreline of Lake Michigan’s Green Bay in Door County, Wisconsin. In 1993, Bell obtained a permit from the Wisconsin Department of Natural Resources (“DNR”) in order to construct a private pier into the bay. In 1998, Bell decided to expand his pier.
