OPINION LUMPKIN, Judge. T1 Appellant, Ricky Ray Malone, was tried by jury and convicted of First Degree Murder (21 0.8.2001, § 701.7) in the District Court of Comanche County, Case Number CF-2005-147. In accordance with the jury's recommendation, the trial court imposed a sentence of death.
