OPINION BY BENDER J.: ¶ 1 The Commonwealth appeals from the July 19, 2005 order granting in part the petition filed by the defendant, Joseph Bradley Rathfon, pursuant to the Post Conviction Relief Act, 42 Pa.C.S. §§ 9541-46 (PCRA).
