Rugg, C.J. The defendant was convicted of murder in the first degree by verdict returned on June 15, 1922. Motion for new trial was filed and after hearing was denied on June 23, 1922. Exceptions were taken to rulings made at the trial. These were overruled by rescript received in the Superior Court on January 9, 1923. The defendant was then on January 16, 1923, sentenced to death.
