RIPPLE, Circuit Judge. Louis Levit, trustee of the bankruptcy estate of Burton L. Stern, appeals the judgment of the district court that his claim against Todd Stern is barred by res judica-ta. For the following reasons, we reverse the judgment of the district court against Levit and remand the case for further proceedings on his claim.
